This document has been drawn up pursuant to art. 13 of EU Regulation 2016/679 (hereinafter: “ Regulation ”) in order to allow you to know our privacy policy, to understand how your personal information is managed when you use our site ( www.maseratincc.it  , hereinafter “ Site ”) and, where applicable, to provide express and informed consent to the processing of your personal data. 1. Who is the controller of your personal data?

2. What is meant by personal data and what data do we process?

“Personal Data” means any information capable of identifying, directly or indirectly, a natural person, in this case You who use the services offered by Maserati NCC.

In particular, we collect and process your personal data necessary for the provision of the requested services, such as:

      • navigation data;
      • personal and identification data (name, surname);
      • contact details (telephone number, email);

3. Why do we process your personal data?

  • Comply with any legal obligations (e.g. accounting and tax).

4. On what basis do we process your personal data?

The condition of lawfulness of the processing of personal data for the purposes referred to in section 4(ab) is art. 6(1)(b) as the processing is necessary for the provision of the Services and for the response to requests from the interested party. The provision of personal data for these purposes is optional but any failure to provide it would make it impossible to activate the Services provided by the Site.

The purpose referred to in section 4(c) represents a legitimate processing of personal data pursuant to art. 6(1)(c) of the Regulation. Once the personal data have been provided, the processing is indeed necessary to comply with a legal obligation to which Maserati NCC is subject.

5. How do we process your data?

Your personal data may be processed manually or using electronic or automatic tools, according to logics strictly related to the purposes themselves or in any case in a way that guarantees the confidentiality and security of the Personal Data (with particular regard to the case of use of remote communication techniques).

6. To whom do we communicate your data?

Your Personal Data may be shared, for the purposes set out in section 4 above, with:

  • entities that typically act as external data controllers after appointment by Maserati NCC, namely: i) individuals, companies or professional firms that provide assistance and consultancy to Maserati NCC in accounting, administrative, legal, tax, financial and debt collection matters relating to the provision of the Services; ii) entities with whom it is necessary to interact for the provision of the Services (for example, hosting providers and banks); iii) or entities delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communication networks);
  • subjects, entities or authorities to whom it is mandatory to communicate your personal data by virtue of provisions of law or orders of the authorities;
  • persons authorised by Maserati NCC to process Personal Data necessary to carry out activities strictly related to the provision of the Services, who have undertaken to maintain confidentiality or have an appropriate legal obligation of confidentiality (e.g. Maserati NCC employees).

7. Where do we transfer your data?

As a rule, we do not transfer your data outside the European Union. Should this happen, we ensure that the recipient complies with the provisions of the Regulation, including the rules specifically dictated for the transfer of personal data to third countries. In particular, we ensure that such transfers take place on the basis of an adequacy decision or the subscription by the controller of standard contractual clauses for data protection approved by the European Commission.

8. How long do we keep your data?

We retain your data only for the time necessary to carry out the processing for the purposes mentioned above.

In particular, we report below the main periods of use and storage of your personal data with reference to the different processing purposes:

  • for the fulfillment of legal obligations, your data will be processed and stored for as long as the need for processing to fulfill said legal obligations persists.

9. What are your rights?

• Right of access: you have the right to obtain confirmation as to whether or not your data is being processed, as well as the right to receive any information relating to the same processing.

• Right to rectification: you have the right to obtain the rectification of your data, if they are incomplete or inaccurate.

• Right to erasure (so-called “right to be forgotten”): in certain circumstances, you have the right to obtain the erasure of your data in our archives if they are not relevant to the continuation of the contractual relationship or are necessary for legal obligations.

• Right to limit processing: when certain conditions occur, you have the right to obtain the limitation of processing, if it is not relevant for the continuation of the contractual relationship or necessary for legal obligation.

• Right to portability: you have the right to obtain the transfer of your data to a different owner.

• Right to object: You have the right to object, at any time for reasons relating to your particular situation, to the processing of data concerning you based on the lawfulness of legitimate interest or the performance of a task of public interest or the exercise of official authority, including profiling.

• Right to withdraw consent: you have the right to withdraw your consent to the processing of your data at any time, without prejudice to the lawfulness of the processing based on consent before the withdrawal.

The exercise of your rights as an interested party is free of charge pursuant to Article 12 of the Regulation.

In any case, you always have the right to lodge a complaint with the competent Supervisory Authority (Guarantor for the Protection of Personal Data), pursuant to art. 77 of the Regulation, if you believe that the processing of your Personal Data is contrary to the legislation in force.

10. How long does this privacy policy apply?

This privacy policy is effective from 03.12.2019 Maserati NCC reserves the right to modify or simply update its content, in part or completely, also due to changes in the applicable legislation. Maserati NCC therefore invites you to visit this section regularly to take note of the most recent and updated version of the privacy policy in order to always be updated on the data collected and on the use that Maserati NCC makes of it.
